Hung Jury Declared in Former IU Student’s Rape Trial

MONROE COUNTY, Ind. — The trial against a former Indiana University student accused of rape has ended in a hung jury.
Jurors in the case of Noah Apgar could not agree beyond a reasonable doubt that he raped a woman at the university in 2024. The trial lasted for four days this week.
“When there’s a hung jury, that usually gives both the prosecution and the defense a trial run at this jury trial,” Attorney Marion Massilimany explained.
The woman in this case came forward with the rape allegations against Apgar on Sept. 13, 2024. She claims Apgar raped her after she repeatedly told him to stop.
“This is a high-profile case and something that the prosecutor’s office has probably focused on a lot,” Massilimany said. “They will more than likely retry this.”
Apgar is still facing a second trial in the case of another woman who came forward claiming Apgar raped her on Sept. 6, 2024. That trial is set for Sept. 14.
Massilimany believes prosecutors may have a “stronger case” against Apgar in the second trial.
“On a Level 3 felony, he (Apgar) is facing three to 16 years in jail on each of these cases,” said Massilimany.
One of the women said she was raped at Apgar’s fraternity house. The other said she was raped at a sorority.
Investigators said the allegations were “similar in nature.”
