Former heavyweight champion Mike Tyson will not be charged for punching a fellow first-class passenger aboard a plane at San Francisco International Airport last month.

The San Mateo County District Attorney’s Office said Tuesday it has closed the case and decided against pursuing charges based on “the circumstances surrounding the confrontation.”

“Unfortunately, Mr. Tyson had an incident on a flight with an aggressive passenger who began harassing him and threw a water bottle at him while he was in his seat,” representatives for Tyson told The Associated Press.

Video of the incident was captured by a fellow passenger and published by TMZ.

In the video, a fellow passenger stands over Tyson’s seat, waving his arms and generally acting like a guy who deserves to get punched. Tyson initially ignores the belligerent passenger. After much thought and consideration, however, the former boxer decides to punch the man instead… repeatedly.

Attorneys for Tyson thanked the San Francisco District Attorney and law enforcement for their “careful, diligent and professional work.”
