BROWNSBURG, Ind.–The teacher accused in a 2023 incident where a student with special needs was forced to eat his own vomit has avoided prison time.

But, Sara Seymour can’t be a teacher in Indiana anymore, agreeing to surrender her teaching license as part of a plea deal that takes her charge down to a misdemeanor.

Pleading guilty to neglect, Seymour was sentenced to a year in jail, with most of that suspended. She also gets credit for time served, so no further jail time will be served. The judge also dismissed an additional charge of failure to make a report.

The incident, which happened Feb. 15, 2023, was in the lunchroom and was caught on video. It wasn’t reported for two months and three other staff members pleaded guilty to failure to report the incident.

The case against assistant Debra Kanipe has not yet been resolved. She is scheduled to go on trial in June and is charged with failure to make a report and neglect of a dependent. Police and prosecutors say she handed the child a spoon.
