VIGO COUNTY, Ind. — Prosecutors will not file any charges against two police officers involved in the shoot out that ended with the death of Terre Haute Police Officer Rob Pitts back in June.

Vigo County prosecutor Terry Modesitt says Officers JT Pearce and Brian Bourbeau were right to return fire when 21-year-old Christopher Wolfe opened fire on the officers as they were responding to a call.

Wolfe had been wanted on murder charges and THPD was tipped off that he might be at the Garden Quarters Apartments in Terre Haute. Modesitt said when officer showed up at the apartment complex Wolfe started shooting at them.

“My office has reviewed the evidence surrounding the shooting,” Modesitt said. “It was determined that Christopher Wolfe fire four shots total. It was further determined that Officer Pierce fired two shots when fired upon and detective Bourbeau also returned fire. These officers exercised self-defense.”

Modesitt said one of of the shots fired by Wolfe was the fatal shot that hit Officer Pitts.

He said an autopsy report confirmed that none of the shots that were fired at Wolfe in return hit Wolfe, but rather he had turn the gun on himself and committed suicide, shooting himself in the head.

Pitts, 45, was a 16-year veteran of the Terre Haute Police Department when he was killed.
