Transgender Rights Advocates Rally Against The Supreme Court's Ban On Gender-Affirming Youth Care

Supreme Court upholds Tennessee ban on surgical mutilation of minors. Common sense wins in SCOTUS. Predictably Sotomayor, Brown, and Kagan dissent.

Tony Katz:  

A 6-3 decision from the Supreme Court they have upheld Tennessee’s ban on transgender surgery and chemical treatments for minors. An absolute win. Although I will say it is shameful to see that it was a six, three decision and John Roberts as a bunch of decisions came out today a little bit all over the map. He’s a very hard guy to follow and a hard guy to understand. But on this. You gotta be very thankful that Donald Trump has a legacy in place. William Jacobson joins me right now. Cornell law professor, the mind behind the legalinsurrection.com. That’s where you can get the story on this 6-3 decision. Let’s talk about the case. William Jacobson, Cornell law professor. What was the argument about and how do you explain what it is?

William Jacobson:

The Supreme Court said this is an issue which for the most part is really up to the states, up to the political process and the way they got to that conclusion. And that’s actually the more or less the concluding paragraph in the opinion by Justice, Chief Justice Roberts. Is what is the test that we’re going to apply? At what level does do the courts review this type of legislation? And the people challenging the legislation said it was discriminatory on the basis of sex, that it was a sex-based categorization because it involves the sex, the birth. Stacks of people and they had a convoluted argument that it was sex-based discrimination because a trans, a boy who wants to be become a woman or whatever, a boy can receive these chemicals, puberty, you know, testosterone. Blockers and girls can’t, and girls can get the shots and boys can’t, and therefore there was a difference in the way boys and girls would be treated under this law. That’s probably a better way of saying it. And the court rejected that. They said this is about medical care and the state has a legitimate interest in protecting the children.
