BLOOMINGTON, Ind. — A man has been arrested in connection to the death of a 20-year-old Indiana University student.

On August 17th the student, Avery McMillan, was unconscious and unresponsive at Eric Montgomery’s home. That prompted him to call 911 for help. Police arrived to administer three doses of Narcan – a medicine used in drug overdoses – but McMillan did not survive.

Police questioned the 33-year-old man, who said he met McMillan around campus the night before. Court documents say that night, McMillan was leaving a house party and eventually met Montgomery at a parking garage. He allegedly gave her alcohol and marijuana and had sex before they went back to the home of Montgomery’s parents, which is where he was living.

After MacMillan’s death, an investigation by Bloomington’s Critical Incident Response Team (CIRT) was opened into Montgomery due to his extensive history of violence.

August 30th during a traffic stop, the CIRT arrested Montgomery for charges of rape and furnishing alcohol to a minor. The investigation into McMillan’s death is still ongoing.
