FISHERS, Ind.–Criminal charges are being filed against a man accused of recording a woman inside a Kroger restroom. 

Matthew Martin, 31, faces one felony count of voyeurism stemming from a May 25 incident at the Kroger store at 116th Street and Cumberland Road. 

A probable cause affidavit filed yesterday says a woman told police she was using the restroom when she observed a cellphone filming her from underneath the stall.

That woman, Cat Westerbeck, was in town from Nevada for the Indy 500. 

Westerbeck said she yelled, “Oh heck no!” and then ran outside to get her husband.

The suspect, later identified as Martin, then ran out of the bathroom, at which point the woman said she grabbed his shirt collar in an attempt to stop him from running.

Police say Martin was able to escape the store, but was later found and arrested. 

Kroger issued this statement about the incident: 

Naturally, we are troubled by this allegation against a customer. Safety and security are always a priority for everyone in our stores.  We are cooperating fully with police as they conduct their investigation. 

In addition to the voyeurism charge, Martin also faces one count of possession of marijuana because officers searched Martin’s vehicle and say they found a small amount of marijuana in the center console..

Court records show Martin was released on pretrial supervision on Thursday.
